Unusual Case Sees Pedestrian Charged in Car Collision

Pedestrians are responsible for following the rules of the road. They can be charged and held responsible if they are the cause of an accident. A recent car – pedestrian collision made the news last week and it was interesting as it resulted in the pedestrian being charge.

A 47-year-old woman was out walking at 11:30 at night when police responded to an accident involving a car and a person. Upon investigation they noted no injuries to the driver or pedestrian, but the car was damaged.

The police issued a summary offence ticket to the pedestrian for failing to yield the right of way to the driver of the car.

While pedestrians are not commonly charged in collisions it does happen regularly. There was a case in the fall in Waterloo Region in which a pedestrian who was struck by a car at Charles and Benson was charged after being struck. In that case a 56-year-old man was hit by the driver and taken to Grand River Hospital with serious but non life-threatening injuries.

The man was charged with falling to use a crosswalk.

If you are out walking always follow the rules, walk on the sidewalk when possible, cross at corners or cross walks, and always be sure to look for oncoming vehicles. Regardless of the fault of the accident, it is rarely the car that is injured.
